Privacy Notice
The protection of your privacy and personal data is important to me. Your data is processed in accordance with applicable data protection provisions, in particular the General Data Protection Regulation (GDPR). Below you will find an overview of the key aspects of data processing on this website.
Collection and Processing of Personal Data | When Visiting this Website
It is possible to access this website without providing any personal data. However, if you choose to contact me via the contact form on the website, by email or by phone, the data you provide will be stored for the purpose of processing your inquiry and for any subsequent communication.
The legal basis for this processing is Article 6(1)(b) GDPR (pre-contractual measures) and Article 6(1)(f) GDPR (legitimate interest in handling general inquiries). Personal data will only be disclosed to third parties where this is necessary for the performance of a contract, required by law, or where you have given your consent.
Collection and Processing of Personal Data | Contractual Relationship
The following personal data is stored for the purpose of customer service and the processing of contractual obligations: your name or company name, profession or business activity, date of birth, company registration number, authorized representatives, contact person, business address and other relevant addresses, telephone numbers, email address, bank account details and your VAT identification number. This data is required to take pre-contractual steps and to conclude and perform a mediation agreement with you. Without this information, no contract can be concluded and mediation services cannot be provided.
The data mentioned in the previous paragraph will be transmitted to my tax advisor in order to comply with my tax obligations. Your bank account details will be transmitted to the account-holding bank solely for the purpose of processing payment of my fees.
Data is retained for the duration of the contractual relationship and, in addition, generally for a period of seven years in order to comply with statutory retention and documentation obligations arising from the Austrian Civil Law Mediation Act (ZivMediatG), the Austrian Commercial Code (UGB), the Austrian Federal Fiscal Code (BAO), and other relevant legal provisions. Further, data may be stored where necessary to comply with legal or contractual obligations, for example in connection with liability or warranty obligations, or to assert or defend claims, particularly relating to fees.
The legal basis for this processing is Article 6(1)(b) GDPR (performance of a contract and pre-contractual measures), Article 6(1)(c) GDPR (legal obligation) and Article 6(1)(f) GDPR (legitimate interest in the establishment, exercise and defence of legal claims).
During mediation, special categories of personal data within the meaning of Article 9(1) GDPR, in particular health data may also come up. Such data is processed exclusively where this is necessary for conducting the mediation. The legal basis is your explicit consent pursuant to Article 9(2)(a) GDPR as well as Article 9(2)(f) GDPR where the processing is necessary for the establishment, exercise or defence of legal claims.
Your personal data is protected by appropriate technical and organisational measures against loss, misuse and unauthorised access.
Storage of Access Data in Server Log Files
Certain data transmitted by your internet browser is automatically collected each time you access this website and stored in so-called server log files. These records are used for internal system-related and statistical purposes. The information collected includes the IP address of the requesting device, the name of the accessed page or file, the date and time of access, the volume of data transferred, the response status (successful/unsuccessful), the web browser used, and, where applicable, the referring website (referrer). This data is used exclusively for system security and to protect against misuse. The data is retained only for as long as necessary to ensure system security and to prevent misuse. The legal basis for this processing is Article 6(1)(f) GDPR (legitimate interest in ensuring the security and stability of the website).
Use of Essential Cookies
This website uses only strictly necessary cookies required for its operation and core functions (e.g. for displaying content, language selection or CMS-based navigation). These cookies are either deleted at the end of your session (session cookies) or remain on your device for a limited period in order to recognize you on your next visit.
Data processing is based on Section 165(3) Austrian Telecommunications Act 2021 (TKG 2021) and Article 6(1)(f) GDPR (legitimate interest in the proper functioning of the website). No consent is required. No analytics, marketing or tracking cookies are used.
Google Fonts
In order to ensure a consistent visual presentation of fonts, this website uses typefaces from the Google Fonts library. Integration is carried out exclusively via the local web server. No connection is established to Google’s servers, and no personal data – especially IP addresses – is transmitted to Google.
Further information on Google Fonts is available here and in Google’s Privacy Policy.
Data Processing by External Service Providers
In order to provide this website and the associated services, I make use of external service providers (e.g. web hosting, domain management, email services and IT service providers). Data processing agreements in accordance with Article 28 GDPR have been concluded with these service providers.
SSL/TLS Encryption
For security reasons and to protect the transmission of confidential content – such as inquiries submitted via the contact form – this website uses SSL/TLS encryption. You can recognize an encrypted connection by the “https://” prefix in your browser’s address bar and the padlock icon. If encryption is active, data that you transmit cannot be read by third parties.
Google Maps
To make my practice locations easier to find, this website provides an external link to Google Maps. Google Maps is not embedded directly into this website. Therefore, no personal data (such as your IP address) is transmitted to Google automatically when you visit this website. A connection to Google's servers is established only if you actively click on the link. In that case, Google may process personal data. Please refer to Google’s Privacy Policy for further information.
External Links
This website contains links to external third-party websites. I have no influence over the data protection practices of these external sites. Responsibility for such content lies solely with the respective operators. Once you access an external link, any data processing is subject to the privacy policy of the respective operator.
Rights of Data Subjects
You have the right to obtain information about the personal data stored about you. You may also request the rectification or deletion of your personal data, data portability, the restriction of processing, or object to the processing of your personal data.
Where processing is based on your consent, you may withdraw your consent at any time with effect for the future. No automated decision-making, including profiling, takes place.
Requests for access to or erasure of personal data in the context of mediation may be limited by the confidentiality obligations under Section 18 ZivMediatG and by the rights of the other mediation party. Information will therefore only be provided insofar as the rights and freedoms of other persons (cf. Article 15(4) GDPR) and statutory confidentiality obligations do not prevent this. Erasure may be restricted for as long as statutory retention obligations apply, in particular under Section 17(3) ZivMediatG and Section 132 BAO.
